1. Agreement
These Terms of Service ("Terms") form an agreement between you and Jorge Mendoza, a sole proprietor based in Illinois, USA ("we," "us," "HomStock"). By downloading, installing, or using the HomStock app ("the App"), you agree to these Terms. If you do not agree, do not use the App.
Your use of the App is also governed by Apple's standard Licensed Application End User License Agreement ("Apple EULA"). In case of conflict between these Terms and the Apple EULA, the Apple EULA controls only to the extent required by Apple.
2. The service
HomStock is a household inventory and shopping-list app. It lets you scan receipts, track what you have, share a shopping list with the people in your household, and see your spending over time.
3. Your account
You sign in with Sign in with Apple. You are responsible for keeping your Apple ID secure. You must be at least 16 years old to use the App. By using the App, you confirm you meet that age threshold.
You can have at most one HomStock account per Apple ID. You may invite or join household members; doing so shares your household content (receipts, shopping list, product catalog) with them.
4. Your content
You retain ownership of the data and photos you put into the App ("your content"). You grant us a limited, non-exclusive license to host, store, transmit, display, and process your content solely for the purpose of operating the App and providing the features you use (including sending receipt text to Google Gemini for parsing, as described in the Privacy Policy).
You are responsible for ensuring you have the right to upload any content. Do not upload content that is illegal, infringing, or that contains another person's data without their consent.
5. HomStock Pro subscription
HomStock offers an optional auto-renewing subscription, HomStock Pro, which unlocks additional features. The current pricing and trial details are shown in the App at the point of purchase and on the App Store listing.
Auto-renewal: Subscriptions automatically renew at the end of each period unless you turn off auto-renewal at least 24 hours before the period ends. Payment is charged to your Apple ID at confirmation of purchase and at each renewal. You can manage and cancel subscriptions in iOS Settings → your Apple ID → Subscriptions.
Free trial: If your subscription includes a free trial, the trial converts to a paid subscription at the end of the trial period unless you cancel before then. Any unused portion of a free trial is forfeited if you purchase a subscription.
Refunds: Refund requests are handled by Apple under their refund policy. We do not process refunds directly.
Right of withdrawal (EU/EEA/UK consumers): Under EU consumer law you normally have a 14-day right of withdrawal for digital services. By starting your subscription, you expressly request that we begin providing the service immediately, and you acknowledge that the right of withdrawal is lost once full performance has begun. You can still cancel auto-renewal at any time as described above.
6. Acceptable use
When using the App, you agree not to:
- Attempt to bypass the free-tier scan limits or other usage controls.
- Reverse-engineer, decompile, or otherwise attempt to extract source code from the App, except to the extent expressly permitted by law.
- Use the App to violate any law or the rights of any other person.
- Send abusive, harassing, or unwanted notifications to other household members.
- Access or attempt to access another user's account or household without their consent.
7. Service availability
We aim to keep the App available and working, but we don't guarantee uninterrupted service. The App relies on third-party providers (Apple, Google) whose availability is outside our control. Features may change, be added, or be removed.
8. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Receipt parsing uses AI and may produce errors — always check the parsed items before relying on the results for budgeting, dietary, allergen, or any other decisions.
Nothing in this section limits warranties or rights that cannot be excluded under applicable consumer-protection law (for EU/EEA/UK consumers, this includes the statutory two-year conformity guarantee).
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim arising out of the App in any 12-month period will not exceed the greater of (a) the fees you paid us in that period for the App or (b) $50 USD.
If you are a consumer in the EU/EEA/UK, nothing in these Terms limits our liability for personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited under applicable law.
10. Termination
You can stop using the App at any time. You can delete your account from Account → Delete Account in the App, which permanently removes your user profile and ledger entries (see the Privacy Policy for what happens to household content). We may suspend or terminate your access if you materially breach these Terms.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Material changes will be announced in the App. Your continued use of the App after a change means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict of laws principles. Disputes arising out of these Terms or the App will be resolved exclusively in the state or federal courts located in Illinois, USA — except where you are a consumer in the EU/EEA/UK or another jurisdiction whose mandatory consumer-protection laws give you the right to bring proceedings in your local courts and have your local law apply. In that case, those rights are preserved.
