Please read these terms carefully before using Qwota.

1. Acceptance of Terms

By downloading, installing, or using Qwota ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Qwota is a fitness and nutrition tracking application that provides:

  • Nutrition and calorie tracking
  • Workout and exercise logging
  • Body composition tracking
  • AI-powered coaching and insights (Qwota Trainer)
  • Integration with Apple HealthKit
  • Cloud sync across devices

3. User Accounts

Account Creation

You may create an account using Sign in with Apple. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Providing accurate and complete information

Guest Mode

You may use the App in guest mode without creating an account. However, your data will only be stored locally on your device and will not sync across devices.

4. Subscription and Payments

Free Features

Qwota offers basic features for free, including:

  • Basic food logging and nutrition tracking
  • Basic workout logging
  • 7-day history access
  • Limited favorites and templates

Qwota Pro Subscription

Premium features are available through Qwota Pro, which includes:

  • AI Coach (Qwota Trainer)
  • Smart Food Scanner (barcode, labels, AI photo)
  • Advanced workout programs
  • Exercise library
  • Apple Health sync
  • Unlimited history and favorites
  • Premium themes
  • Home screen widget

Payment Terms

  • Subscriptions are billed through your Apple ID account
  • Monthly or yearly subscription options are available
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
  • You can manage or cancel your subscription in your Apple ID settings
  • Lifetime purchases are one-time payments and do not renew

Refunds

Refund requests are handled by Apple in accordance with their App Store policies. Please contact Apple Support for refund inquiries.

5. User Responsibilities

You agree to:

  • Use the App only for lawful purposes
  • Not attempt to reverse engineer, modify, or distribute the App
  • Not use the App to transmit harmful, offensive, or illegal content
  • Not interfere with or disrupt the App's functionality
  • Provide accurate information when using the App

6. Health and Medical Disclaimer

IMPORTANT: Qwota is not a medical device or service and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • The calorie calculations, nutrition targets, and fitness recommendations provided by the App are estimates based on general formulas and the information you provide
  • AI coaching insights are generated by artificial intelligence and should not be considered professional medical, nutritional, or fitness advice
  • Always consult with qualified healthcare professionals before starting any diet, exercise program, or making changes to your health regimen
  • If you have any medical conditions, are pregnant, nursing, or taking medications, consult your doctor before using the App
  • Stop using the App and seek medical attention if you experience any adverse effects

7. Intellectual Property

All content, features, and functionality of Qwota, including but not limited to text, graphics, logos, icons, images, and software, are the exclusive property of Qwota and are protected by copyright, trademark, and other intellectual property laws.

8. User Content

You retain ownership of any content you create within the App (custom foods, workouts, notes, etc.). By using the App, you grant us a limited license to process and store this content solely to provide the App's services.

9. Third-Party Services

The App integrates with third-party services (Apple HealthKit, Firebase, food databases). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The App is provided "as is" without warranties of any kind
  • We do not guarantee the accuracy, completeness, or reliability of any information in the App
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for the App in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless Qwota, its affiliates, and their respective officers, directors, and employees from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the App ceases immediately
  • You may lose access to your data stored in the App
  • Provisions that by their nature should survive termination will survive

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Qwota regarding use of the App.
